Terms & Conditions

These Terms & Conditions ("Terms") apply when you use kellyanngarnett.com and related pages (the "Site"), book a call, or buy a session, program or other offer from Kelly Ann Garnett [add registered business name if different] ("Kelly," "we," "us"). By using the Site, booking or buying, you agree to these Terms. If you do not agree, please do not use the Site.
If you sign a separate coaching agreement with us, that agreement applies together with these Terms and takes priority where the two differ.
1. Who can use the Site
You must be at least 18 years old to use the Site, book a call or make a purchase.
2. Coaching is not therapy
Kelly is a dating and relationship coach. Coaching is an educational and supportive service. It is not psychotherapy, counseling, or medical, mental-health, legal or financial advice, and it is not a substitute for any of them. Kelly does not diagnose or treat any condition.
If you are under the care of a health professional, please keep following their advice and consider telling them you are working with a coach. If you are in crisis or thinking about harming yourself or someone else, call or text 988 (the Suicide & Crisis Lifeline in the United States) or call 911.
You are responsible for your own choices and actions, including your decisions about dating, relationships and meeting people in person.
3. No guaranteed results
We cannot promise that you will meet a partner, start or keep a relationship, or reach any other specific outcome. Results depend on many things outside our control, including your own effort and circumstances. Testimonials on the Site describe individual experiences and are not a promise that you will have the same result.
4. Using the Site
You may use the Site for your own personal, non-commercial purposes. You agree not to:
use the Site in a way that breaks the law or harms anyone;
submit false information or pretend to be someone else;
copy, scrape, resell or republish Site content;
interfere with the Site, its security or its forms.
Quizzes, blog posts, guides and other free content are for general information and self-reflection only. A quiz result is not a professional assessment.
5. Booking calls
Calls and sessions are booked through our online scheduler and held by video (Zoom) or phone unless we agree otherwise.
The free Create Your Dating Map session is offered at our discretion. It is limited to one per person, and we may decline or cancel a booking.
Please give accurate contact details and join on time. Sessions end at the scheduled time even if you join late.
To reschedule, give at least 24 hours' notice using the link in your confirmation email or by emailing kelly@kellyanngarnett.com.
If we need to move a session, we will tell you as early as we can and offer a new time.
6. Purchases and payment
Prices are in US dollars and are shown at checkout or in your written offer. Prices and offers can change at any time before you buy.
Payment is due in full at purchase unless we agree to a payment plan in writing. Payments are processed by Stripe or PayPal under their own terms.
If you are on a payment plan, you authorize us to charge each installment when due. You owe every installment even if you stop taking part in the program.
If a payment fails, we may pause your sessions and access until it is paid.
You are responsible for any taxes that apply to your purchase.
7. Refunds, rescheduling and cancellations
All sales are final. We do not offer refunds for sessions, coaching programs, workshops or digital products, except where the law requires one.
You may reschedule a session at no charge with at least 24 hours' notice.
A session that is missed, or changed with less than 24 hours' notice, counts as used and is not refunded or rescheduled.
Sessions in a program must be used within the program period stated in your offer. Unused sessions expire.
If we cancel a paid session or program and cannot offer another date, we will refund the unused portion.
Please contact us before disputing a charge with your bank or card company, so we can try to resolve it directly.
8. Intellectual property
The Site and everything on it or delivered through our programs, including text, quizzes, guides, workbooks, videos, recordings, graphics and the names and logos we use, belong to Kelly or her licensors. When you buy a program or product, you receive a personal, non-transferable license to use the materials for your own growth. You may not share, copy, sell, teach from or publish them without written permission.
9. What you send us
You keep ownership of anything you send us. If you give us a testimonial or review, we will ask your permission before publishing it, and you can withdraw that permission for future use by emailing us.
10. Emails
When you take a quiz, request a resource, book a call or buy from us, we may send you emails related to that request and to our content and offers. You can unsubscribe at any time using the link in any email.
11. Other websites and tools
The Site uses and links to services run by other companies, such as scheduling, video, quiz, payment and social media services. We do not control them and are not responsible for their content, availability or practices.
12. Disclaimers
The Site, its content and our services are provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Site will be uninterrupted, error-free or secure.
13. Limit of liability
To the fullest extent allowed by law, Kelly will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or emotional distress, arising from your use of the Site or our services. Our total liability for any claim will not be more than the amount you paid us in the 12 months before the claim arose, or US $100 if you have paid nothing.
Nothing in these Terms limits liability that cannot be limited under California law.
14. Your responsibility to us
You agree to cover claims, losses and reasonable costs brought against us by others that result from your misuse of the Site or our materials, or from your breach of these Terms.
15. Ending access
We may suspend or end your access to the Site or a program if you break these Terms or behave abusively toward Kelly or other participants. Fees already paid are not refunded in that case.
16. Governing law and disputes
These Terms are governed by the laws of the State of California. If a problem comes up, please email us first; both sides agree to try in good faith to settle it informally for at least 30 days. Any legal action that follows must be brought in the state or federal courts located in San Diego County, California.
17. General
If any part of these Terms is found unenforceable, the rest stays in effect.
If we do not enforce a term, that is not a waiver of it.
These Terms, our Privacy Policy and any coaching agreement you sign are the whole agreement between us on these subjects.
We may update these Terms by posting a new version on this page with a new effective date. The version in place when you buy applies to that purchase.
